Protection of personal data

If you are my customer, newsletter subscriber or website visitor, you are entrusting me with your personal information. I am responsible for their protection and security. Therefore, please familiarize yourself with the protection of personal data, the principles and the rights you have in connection with the GDPR (Regulation on the Protection of Personal Data).

Who is the administrator:

I, Ing. Robert Ach-Hübner, ID number: 14063921, VAT ID: CZ9010314104, permanent address Kamenná 199/25, 639 00, Brno – Štýřice, operate the website www.pribehyradosti.cz. I process your personal data as the administrator, which means I determine how personal data will be processed, for what purpose, for how long, and I select any other processors who will assist me with the processing.

Declaration:

I declare that as the administrator of your personal data, I fulfill all legal obligations required by the applicable legislation, especially the Personal Data Protection Act and GDPR. Specifically:

  • I will process your personal data only based on valid legal reasons, including legitimate interest, contract fulfillment, legal obligations, or granted consent.

  • I fulfill the information obligation according to Article 13 of GDPR before starting the processing of personal data.

  • I will enable and support you in exercising and fulfilling your rights under the Personal Data Protection Act and GDPR.

Scope of personal data and processing purposes:

I process personal data that you entrust to me for the following purposes:

  1. Service provision, contract fulfillment:

    • Your personal data (email) is necessary for contract fulfillment (e.g., providing access to an application, sending online courses, delivering goods, providing course information, etc.).

  2. Accounting:

    • If you are a customer, I need your personal data (billing information) to comply with legal obligations related to issuing and recording tax documents.

  3. Marketing – Sending newsletters:

    • I use your personal data (email, first name, and last name) for direct marketing purposes (sending business communications). If you are my customer, I do so based on legitimate interest, assuming that you are interested in my updates, for a period of 5 years from the last interaction. If you are not my customer, I send newsletters to you only based on your consent, for a period of 5 years from the granting. In both cases, you can revoke this consent by using the unsubscribe link in every email sent.

    • 4. Photographic Documentation:

    • I can use your photographs, references, feedback, and other related materials only based on your consent. This permission remains in effect until you choose to revoke it.

    • We retain your personal data for the duration of statutory limitation periods unless the law specifies a longer retention period or we have indicated otherwise in specific cases.

    • Cookies:

    • When you browse my website, I record your IP address, the duration of your visit, and the referring page. I consider the use of cookies for measuring website traffic and customizing the display of web pages as my legitimate interest as the administrator. I believe this allows me to offer better services.

    • Cookies for targeted advertising will be processed only based on your consent.

    • You can also browse my website in a mode that does not collect personal data. You can disable cookies on your computer.

    • Security and Personal Data Protection:

    • I protect your personal data to the fullest extent possible using modern technologies commensurate with technical advancements. I treat your data as if it were my own. I have adopted and maintain all feasible (currently known) technical and organizational measures to prevent misuse, damage, or destruction of your personal data.

    • Transfer of Personal Data to Third Parties:

    • My collaborators have access to your personal data. To ensure specific processing operations that I cannot handle independently, I utilize or plan to utilize services and applications from processors who specialize in data protection even better than I do. These include:

    • Application providers for communication, web, and invoicing.

    • Application providers for email communication and customer support.

    • Facebook and Google.

    • IT service and hosting providers.

    • Payment gateway providers.

Additional Applications and Data Processing:

It’s possible that in the future, I may decide to utilize additional applications or processors to streamline and enhance data processing. However, I promise that in such cases, we will impose the same stringent requirements on processors regarding security and processing quality as we do on ourselves.

Data Transfer Outside the EU:

All personal data processing will occur within the EU.

Your Rights Regarding Personal Data Protection:

In the context of personal data protection, you have several rights. If you wish to exercise any of these rights, please contact me via email at robert.hubner@gmail.com.

  1. Right to Information:

    • This right is already fulfilled by this information page outlining the principles of personal data processing.

  2. Right of Access to Personal Data:

    • You can request access to your personal data at any time, and I will provide you with a report within 30 days detailing what personal data I process and why.

  3. Right to Rectification:

    • If anything changes or if you find your personal data inaccurate or incomplete, you have the right to request corrections or updates.

  4. Right to Restriction of Processing:

    • You can use this right if you believe I process inaccurate data, if you suspect unlawful processing, or if you want to limit data deletion. For example, unsubscribing from newsletters restricts processing for marketing communications.

  5. Right to Data Portability:

    • If you want to take your personal data and transfer it to someone else, I will follow a similar process as with the right of access, providing the information in machine-readable format. This may take at least 90 days.

  6. Right to Erasure (Right to Be Forgotten):

    • If you wish to have your personal data deleted, I will comply with this request.

Your Right to Erasure (Right to Be Forgotten):

You have the right to request erasure (to be forgotten). While I don’t want to forget about you, if you choose to exercise this right, I will delete all your personal data from my system and from the systems of any subprocessors. To ensure this right, we need 90 days.

In some cases, I am bound by legal obligations—for example, I must retain tax documents for the period specified by law. In such cases, I will delete any personal data not subject to other legal requirements. We will inform you via email once the erasure process is complete.

Complaint to the Data Protection Authority:

If you believe that I am not handling your data in accordance with the law, you have the right to file a complaint with the Data Protection Authority. However, I would appreciate it if you first inform me of any concerns so that I can address and rectify any potential mistakes.

Unsubscribing from Newsletters and Marketing Communications:

I send emails with inspiration, articles, videos, invitations, products, and services to you based on my legitimate interest if you are my customer.

If you are not yet a customer, I send emails only based on your consent. In both cases, you can unsubscribe from my emails by clicking the unsubscribe link in each email.

Confidentiality:

I assure you that my collaborators who process your personal data are obligated to maintain confidentiality regarding personal data and security measures. This confidentiality extends even after our contractual relationship ends. Without your consent, your personal data will not be disclosed to any other third party.
